CSPA Supports New Endangered Species Regulations
WASHINGTON, DC (August 3, 2004) -- The Consumer Specialty Products Association (CSPA) praised the U.S. Fish and Wildlife Service and the National Marine Fisheries Service today for concurrently promulgating Counterpart Regulations that will provide flexibility in enforcement of the Endangered Species Act (ESP).
Steve Kellner , CSPA's Senior Vice President and General Council, said the services action will eliminate duplicative, unnecessary and burdensome consultations without weakening the protection of endangered species. “The new regulations provide a process that takes advantage of EPA's broad knowledge and expertise while ensuring oversight to the consulting service agencies,” he said.
The Endangered Species Act requires EPA to consult with the services to ensure that pesticide products registered under the Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) are not likely to harm endangered or threatened species or their habitat. Under the counterpart regulations promulgated concurrently by the two services on July 29th, the EPA will determine whether a product will harm a species or its habitat and the two services can review those decisions.
